Refunds and cancellation.
01Why this policy exists
NAND builds bespoke websites, interactive 3D experiences and custom interfaces. Starting a project means reserving time, planning the architecture and doing design and development work. This policy aims to account fairly for the work delivered and the expenses incurred.
No payments are taken through this website. Any advance and the payment terms for a project are agreed in writing for that project.
02Cancelling a project
If you pay an advance and then cancel the project in writing:
- Completed work: NAND fairly assesses the work actually completed up to the date of your written cancellation.
- Documented expenses: NAND calculates the reasonable, documented costs properly connected with the project, including non-refundable third-party expenses where they apply (for example pre-agreed API keys, font licences or staging servers).
- Reconciliation: the amount for completed work and those costs is deducted from the advance, and any remaining unearned balance is refunded to you.
- If the amount equals the advance, there is no balance to refund.
- If the amount is more than the advance, NAND keeps the advance as compensation for the work delivered and does not ask for more, unless this was agreed in writing.
Safeguards: every deduction must have a reasonable, objective basis and must never include duplicate charges. You receive a clear written explanation of the calculation together with the work in progress. The advance is not treated as automatically non-refundable.
03Cancellation after a milestone is approved
Once a milestone (for example the visual design or an interactive staging preview) has been approved in writing:
- fees for that approved milestone are non-refundable;
- future milestones that have not been billed are cancelled, and work stops.
04If NAND cannot deliver
If NAND cannot deliver agreed work because of technical impossibility or events beyond its control:
- NAND delivers all completed source files and work in progress;
- NAND refunds a proportional amount for any undelivered work that has been paid for.
05Delays and inactivity
- Inactive project: a project becomes inactive if the client does not provide essential materials, content, feedback or milestone approvals for 14 consecutive business days after a written request.
- Written warning: on business day 10 without a response, NAND sends a written notice of an upcoming pause, giving four business days to respond.
- Pause: if there is still no response by business day 14, the project is paused and the reserved development time is released.
06Resuming a paused project
- Within one week of the pause date: no reactivation charge applies.
- After one week: NAND may assess a reasonable, case-specific resumption charge based on the additional work and expenses actually connected with the pause and the restart, such as repeating incomplete work, re-planning, or server costs incurred.
There is no fixed percentage or penalty. NAND explains any proposed charge and its basis in writing and gets your written approval before resuming chargeable work, and never charges twice for the same work or expense.
07Support and maintenance
- Two-month support: included with every standard website build at no charge, so there is nothing to refund.
- 12-month maintenance subscription: invoiced annually in advance. Subscription fees are non-refundable once the term begins, except where NAND fails to provide the technical assistance.
